clone stamp tool intricacies?

I have two pictures open (Adobe Photoshop v8.0 for Mac OSX). One is "RGB/8#" and the other is "(RGB/8*)." I'm trying to use the clone stamp tool to copy one little portion from one picture to the other but nothing is happening. Both pictures have gone through "Merge Layers." What is keeping me from using the clone stamp tool from one picture to the other??
