Thanks Erik, that works slick wish I'd known about it earlier .
I tried the Command Click but couldn't get the dialog box you mentioned I had to create the New Layer set by selecting it from the drop down menu.
However in the process of trying that I found that if I Command Click when I have the Move tool selected, the layer that the cursor happens to be on at the time will be highlighted in the Layer Box.
